These Terms of Service (“Terms”) govern your access to and use of the GoHumanize.AI website, applications, and related services (collectively, the “Service”). By accessing or using the Service, you agree to comply with and be bound by these Terms. If you do not agree, you must not use the Service.

7. Refunds and Payment Disputes
7.1 No Refunds
All purchases are final and non-refundable. Due to the nature of the Service as an immediately accessible digital product, you acknowledge that access is granted instantly upon purchase, and you waive any rights to refunds, withdrawal, or cooling-off periods to the fullest extent permitted by applicable law.
This applies to all transactions, including but not limited to subscriptions, Credits, upgrades, downgrades, and promotional purchases.
You may cancel your subscription at any time through your account settings. Cancellation will prevent future billing but will not result in any refund for the current or prior billing periods. Any remaining Credits will remain available until the end of the active billing cycle and will expire thereafter.

If you initiate a dispute without first providing us an opportunity to resolve the issue within a reasonable timeframe (at least 14 days):

If a confirmed technical error results in incorrect charges (such as duplicate billing or charges for services not provided due to system failure), we may issue an account credit or billing adjustment. Requests must be submitted within 30 days of the charge and include relevant transaction details.

You own the Output generated from your Content, subject to applicable laws.

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. This includes, without limitation, implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not guarantee that:
AI detection technologies are continuously evolving, and results may vary. Any references to success rates are based on internal testing conducted at a specific time and do not represent guarantees or assurances of future performance.
Your use of the Service is entirely at your own risk.
12. Limitation of Liability
To the maximum extent permitted by law, GoHumanize.AI and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, regardless of the legal theory and even if advised of the possibility of such damages.
In all cases, our total cumulative liability for any claims arising out of or relating to the Service or these Terms shall not exceed the lesser of:
(a) the total amount paid by you to us in the three (3) months preceding the event giving rise to the claim; or
(b) fifty U.S. dollars (USD $50).
Some jurisdictions do not permit certain limitations of liability, so portions of the above may not apply. In such cases, liability will be limited to the fullest extent permitted by applicable law.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing cycle. No refunds will be issued, and unused Credits will expire at the end of that period.

15. Dispute Resolution and Arbitration
15.1 Informal Resolution
Before initiating formal proceedings, you agree to contact us at hello@gohumanize.ai and allow at least thirty (30) days for a good-faith attempt to resolve the dispute.
15.2 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or your relationship with us shall be resolved through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in English, and the arbitrator’s decision may be entered in any court with jurisdiction.
15.3 Waiver of Class Actions and Jury Trials
You and GoHumanize.AI agree that all claims must be brought individually and not as part of any class, collective, or representative action. The arbitrator may not consolidate claims or preside over class proceedings. Both parties waive any right to a jury trial.
If this waiver is found unenforceable, the arbitration provision will be void, and disputes will be resolved in court.

Either party may seek injunctive or equitable relief in court for intellectual property matters or pursue claims in small claims court where applicable.

You may opt out of this arbitration agreement by submitting written notice to hello@gohumanize.ai within thirty (30) days of account creation. The notice must include your identifying details and a clear statement of intent to opt out. If you opt out, disputes will be resolved exclusively in the courts specified in Section 16.

We reserve the right to update or modify these Terms at any time. We will provide notice of any material changes by posting the revised Terms on our website. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must discontinue use of the Service and cancel your account.
18. Force Majeure
We are not liable for any delay or failure in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, power or network outages, cyberattacks, interruptions by third-party service providers (such as cloud hosting, AI processing, or payment processors), changes in applicable laws or regulations, and labor disputes.

These Terms represent the full agreement. If any part is invalid, the rest remains enforceable. Failure to enforce rights is not a waiver. Assignment is restricted without consent. Notices may be sent via email or the Service. No third-party rights are created.
